United States of Care Responds to Over-the-Counter Preventive Services Proposed Rule
On December 18, 2024, United States of Care (USofCare) submitted a response to a proposed rule from the Internal Revenue Service (IRS), the Employee Benefits Security Administration (EBSA), and the Centers for Medicare & Medicaid Services (CMS) entitled “Enhancing Coverage of Preventive Services Under the Affordable Care Act.”
Despite significant coverage and affordability gains under the Affordable Care Act (ACA), access to free preventive care for over 150 million people remains in jeopardy due to ongoing litigation targeting the ACA’s preventive services mandate. Building on recently issued guidance clarifying billing procedures and our response to the Departments’ previous Request for Information (RFI) on this topic, USofCare’s comments strongly support the proposed rule to ensure cost-free access to over-the-counter (OTC) preventive care and offer additional recommendations in order to meet people’s needs for the health care system.
