USofCare Urges U.S. Supreme Court to Protect No-Cost Preventive Care in Braidwood v. Becerra

Washington, DC — On Friday, the Supreme Court of the United States announced its decision to hear arguments in Braidwood Management Inc. v. Becerra, a case that previously received a mixed ruling from the Fifth Circuit Court of Appeals in June 2024. The lawsuit’s review by the nation’s highest court will determine whether 151 million people will continue to have access to preventive health care services with no out-of-pocket costs as part of a mandate for insurers in the Affordable Care Act (ACA). 

“While the Fifth Circuit Court’s decision kept access to critical free preventive services for millions of people in place for the time being, it left the door open for further legal action that could eliminate these protections,” said United States of Care CEO and Co-Founder Natalie Davis. “By taking up this case, the Supreme Court has the responsibility to protect life-saving free preventive health care for over 151 million Americans — including 37 million children.

“Services like cancer screenings, immunizations, contraception, and behavioral health assessments have saved millions of lives, and eliminating free access to these services would worsen health disparities and health outcomes — especially among people of color and lower-income communities. We know that people want access to quality, affordable health care that they can rely on. By making people pay for care that was once free, eliminating these protections would inject uncertainty into our health care system and amplify the anxiety we know people already have about the cost of health care. We urge the Supreme Court to shut the door on these efforts to eliminate free access to preventive care services and keep people healthy.”
